TERMS & CONDITIONS

These Terms & Conditions govern all reservations, accommodations, facilities, services, and use of Duchamp Hotel. By making a reservation, checking in, occupying a guest room, or using Hotel facilities, Guest agrees to be bound by these Terms & Conditions.

1. RESERVATIONS & DEPOSITS

Reservations are not confirmed until accepted by Hotel and a confirmation number has been issued. A valid credit card is required to secure all reservations. Deposit requirements may vary based on season, rate plan, special events, group bookings, or promotional offers.

2. RATES, TAXES & FEES

All rates are quoted in U.S. Dollars and are subject to applicable taxes, assessments, and government-imposed fees. Additional charges for incidentals, upgrades, special services, parking, damages, extraordinary cleaning, or other authorized charges may apply.

3. CHECK-IN & CHECK-OUT

Check-in begins at 3:00 PM. Check-out is 11:00 AM. Early arrivals and late departures are subject to availability and may incur additional charges. Unauthorized late departures may result in additional fees, including an additional night's room charge.

4. PAYMENT AUTHORIZATION

Guest authorizes Hotel to charge all room charges, taxes, fees, incidentals, damages, extraordinary cleaning charges, smoking violations, unauthorized animal charges, missing property charges, chargeback-related costs, collection costs, and other authorized amounts to the payment method provided.

5. CANCELLATION & MODIFICATION POLICY

Cancellation and modification policies vary by reservation type and rate plan. Applicable cancellation terms disclosed during booking are incorporated into the reservation agreement.

6. OCCUPANCY & AGE REQUIREMENTS

Duchamp Hotel is an adults-only property. All registered guests must be at least twenty-one (21) years of age.

7. VISITOR POLICY

Hotel reserves the right to limit or prohibit visitors at any time. Registered guests may not host parties, receptions, commercial activities, or gatherings without prior written approval.

8. SMOKING, VAPING & CANNABIS POLICY

Duchamp Hotel is a smoke-free property. Smoking, vaping, cannabis use, cigars, e-cigarettes, and similar products are prohibited anywhere on Hotel property.

9. PET POLICY

Duchamp Hotel is a pet-free property. Pets are not permitted. Service animals are accommodated as required by law.

10. POOL & SPA RULES

No lifeguard is on duty. Glass containers are prohibited. Pool and spa facilities close promptly at 10:00 PM daily.

11. PARKING & VEHICLE LIABILITY

Parking is provided as a convenience to guests. Hotel assumes no responsibility for theft, damage, vandalism, or loss involving vehicles or their contents.

12. GUEST CONDUCT

Quiet hours shall be observed from 10:00 PM until 8:00 AM. Violations may result in removal without refund.

13. DAMAGE, MISSING PROPERTY & EXTRAORDINARY CLEANING CHARGES

Guest accepts full responsibility for any damage to guest rooms, furnishings, fixtures, equipment, common areas, landscaping, pool facilities, or any other portion of Hotel property caused by Guest or Guest's party, invitees, visitors, or vendors.

Guest is responsible for the replacement cost of any Hotel property removed, damaged, destroyed, stained, soiled beyond normal use, or not returned, including but not limited to robes, towels, linens, bedding, pillows, artwork, décor, electronics, furnishings, glassware, silverware, kitchenware, and amenity items.

Hotel is authorized to charge the credit card on file for damages, excessive cleaning, smoking or vaping violations, unauthorized pets, pet-related damage, stains, odors, bodily fluids, human or animal waste, vomit, biohazard remediation, pest treatment, missing items, repair costs, replacement costs, labor, loss of use, and any other reasonable costs incurred as a result of Guest's occupancy or use of the property.

Certain furnishings, artwork, décor, linens, robes, and amenity items are custom, specialty, or limited-availability items. Replacement charges may include actual replacement cost, shipping, procurement, installation, cleaning, restoration, and reasonable administrative expenses.

If damages or charges exceed any deposit or credit card authorization, Guest shall remain fully responsible for all additional amounts due.

14. LIMITATION OF LIABILITY

Hotel shall not be liable for loss, theft, damage, or destruction of Guest property except as required by law.

15. FORCE MAJEURE

Hotel shall not be liable for events beyond its reasonable control.

16. DISPUTE RESOLUTION

Disputes shall be resolved through negotiation, mediation, and binding arbitration in Sonoma County, California. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

17. GOVERNING LAW

These Terms & Conditions shall be governed by California law.

18. CHARGEBACKS & PAYMENT DISPUTES

Hotel may provide reservation records, agreements, invoices, photographs, correspondence, and policy acknowledgements in response to disputed charges.

19. RIGHT TO REFUSE SERVICE

Hotel reserves the right to refuse service or remove any Guest whose conduct is unlawful, disruptive, threatening, unsafe, or abusive.

SMS and Text Messaging Policy

We use a guest messaging platform to communicate with you regarding your stay. By providing your phone number during the booking process, you consent to receive text messages from the property.

Purpose: Text messaging may be used to send check-in instructions, access information, room readiness updates, and to respond to your requests during your stay.

Opt-Out: You may opt out of receiving text messages at any time by replying STOP to any message you receive. You will receive a final confirmation message, after which no further SMS messages will be sent.

Help: If you experience issues or need assistance, you may reply HELP or contact the front desk directly.

Privacy of Mobile Data: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging opt-in data and consent will not be shared with any third parties20
